1. Acceptance of Terms

Welcome to Absolute Roleplay ("Service", "Platform", "we", "us", or "our"). By accessing or using our website, services, or any associated applications, you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations.

If you do not agree with any part of these Terms, you must not use our Service. Your continued use of the Service constitutes your acceptance of these Terms and any future modifications.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

2. Age Requirement and Eligibility

2.3 Consequences of Misrepresentation

4. User Content and Conduct

4.1 User-Generated Content

Users may create, upload, and share content including but not limited to character profiles, roleplay stories, images, and other creative works ("User Content"). You retain ownership of your original User Content but grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.

4.2 Content Responsibility

You are solely responsible for your User Content. By posting content, you represent and warrant that:

• You own or have the necessary rights to use and authorize use of the content
• The content does not infringe upon intellectual property rights of any third party
• The content complies with all applicable laws and these Terms
• You have obtained consent from any individuals depicted in your content

4.3 Prohibited Content

The following content is strictly prohibited and will result in immediate account termination:

• PhotosReal life images or synthetically generated realistic images.
• Child Sexual Abuse Material (CSAM): Any sexual or suggestive content involving minors, including fictional depictions, is absolutely prohibited. This includes "aging up" minor characters or any content sexualizing individuals under 18.
• Non-Consensual Content: Real non-consensual intimate images, revenge pornography, or content depicting actual sexual assault
• Illegal Content: Content that promotes, depicts, or facilitates illegal activities including but not limited to human trafficking, bestiality, or actual violence
• Harassment and Abuse: Content intended to harass, threaten, stalk, doxx, or harm other users
• Hate Speech: Content promoting hatred, discrimination, or violence against individuals or groups based on protected characteristics
• Impersonation: Content that impersonates real individuals without their consent, particularly in sexual or defamatory contexts
• Malware and Spam: Content containing viruses, malicious code, or unsolicited commercial communications
• Social or Political Content: Content containing social, political or religious ideologies regardless subject matter.

4.4 NSFW Content Guidelines

Adult content is permitted on this platform subject to the following requirements:

• All adult content must be properly tagged and marked as NSFW
• All individuals depicted must be clearly adults (18+)
• All depicted scenarios must involve consent (fictional consent for roleplay purposes is acceptable)
• Content must comply with all applicable laws in your jurisdiction

4.5 Roleplay Content

This platform is designed for creative roleplay. Users engaging in roleplay must:

• Clearly distinguish between in-character and out-of-character communications
• Respect boundaries and consent of roleplay partners
• Not use roleplay as a pretext for harassment or abuse
• Ensure all characters in adult roleplay scenarios are depicted as adults

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by Absolute Roleplay and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

5.2 Third-Party Content

This platform is designed for use with Final Fantasy XIV, which is a registered trademark of Square Enix Holdings Co., Ltd. We are not affiliated with, endorsed by, or sponsored by Square Enix. All Final Fantasy XIV content and materials are trademarks and copyrights of Square Enix Holdings Co., Ltd.

5.3 DMCA Compliance

We respect intellectual property rights and will respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed, please contact us with the required DMCA notice information.

6. Privacy and Data Protection

6.1 Data Collection

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ABSOLUTE ROLEPLAY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

7.4 User Interactions

We are not responsible for the conduct of any user on or off the Service. You agree to take reasonable precautions in all interactions with other users, particularly if you decide to communicate off the platform or meet in person.

8. Indemnification

You agree to defend, indemnify, and hold harmless Absolute Roleplay and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User Content
• Your use of the Service
• Your violation of any rights of another user or third party

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features if available. Termination does not relieve you of obligations incurred prior to termination.

9.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Conduct that we determine to be harmful to other users or the Service
• Extended periods of inactivity
• Request by law enforcement or government agencies

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content without obligation to retain or provide copies. Provisions of these Terms that by their nature should survive termination shall survive.

10. Dispute Resolution

10.1 Informal Resolution

Before filing a claim, you agree to first contact us and attempt to resolve any dispute informally. Most disputes can be resolved through good-faith discussion.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

10.3 Waiver of Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Reporting and Moderation

11.1 Reporting Violations

If you encounter content or behavior that violates these Terms, please report it using our in-platform reporting tools or by contacting us directly. We take all reports seriously and will investigate appropriately.

11.2 Moderation Actions

We reserve the right to remove content, issue warnings, temporarily suspend, or permanently ban users who violate these Terms. Moderation decisions are at our sole discretion, though we strive to be fair and consistent.

11.3 Cooperation with Authorities

We will cooperate with law enforcement authorities as required by law. We may report illegal content, including but not limited to CSAM, to appropriate authorities including the National Center for Missing & Exploited Children (NCMEC).

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Absolute Roleplay concerning the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

12.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

12.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
